Based on a recent ruling in the 7th Circuit Court of Appeals, Denver employers are not liable for unauthorized overtime in excess of 40 hours per week if they did not know or had reason to know of overtime worked. Until further notice, employers should continue using the Form I-9 currently available on the forms section of the U.S. Citizenship and Immigration Services (USCIS) website (uscis.gov). This form should continue to be used even after the Office of Management and Budget (OMB) control number expiration date of August 31, 2012 has passed. USCIS will provide updated information about the new version of the Form I-9 as it becomes available.
