Even though the Obama administration has delayed enforcement of the employer “play or pay” provisions of the Affordable Care Act until Jan. 1, 2015, employers still have to comply with the provisions of the law requiring them to notify employees by Oct. 1, 2013, of their health insurance options in 2014.
The U.S. Department of Labor (DOL) recently issued guidance stating that:
- by Oct 1, employers must notify current employees and new employees hired on or after that date of the health plans (if any) the employer will offer
- the availability of health coverage through the new public health insurance exchanges (now called marketplaces).
- new employees must be notified by mail or electronically at the time of hire, or within 14 days of their start date.
Two Model Notices for Employers
The DOL has developed two model notice forms for employers to use in complying with the notice requirement--one for employers that plan to offer coverage and one for those who don’t.
Employers can use their own form as long as it contains the required information.
